While fiancé and marriage visas are increasingly complicated procedurally and legally, some basic information about these visas is provided below.
Visas for Fiancés and Foreign Spouses
- K-1 Visas: A fiancé of a U.S. citizen is eligible for a K-1 fiancé visa. The U.S. citizen and his or her fiancé(e) must show proof of their relationship and their intention to marry each other within 90 days once the fiancé enters the United States. The application process for K-1 visa generally takes between four to 24 months depending on the nationality of the fiancé.
- K-3 Visas: A spouse of a U.S. citizen is eligible for a K-3 visa. A K-3 visa allows a spouse of a U.S. citizen to enter the U.S. while waiting for the approval of the spouse petition for a green card. The application process for K-3 visa may take several months and last up to one year.
Visas for Children of Fiancés and Foreign Spouses
- K-2 Visas: People who are under the age of 21, unmarried and the children of K-1 fiancé visa holders or applicants can obtain a K-2 visa that allows them to enter the United States to await the availability of an immigrant visa.
- K-4 Visas: People who are under the age of 21, unmarried and the children of K-3 foreign spouse visa holders or applicants can obtain a K-4 visa that allows them to enter the United States to await the availability of an immigrant visa.
